A Lasting Power of Attorney is a legal document, It will allow someone, you appoint and that you trust as an “attorney” to make decisions on your behalf, if you are no longer wish to or able to due to your mental capacity.
Lasting Powers of Attorney for both Property, Financial, Health and welfare
This could just be a temporary situation: for example, if you’re in a hospital and need help with everyday tasks such as paying bills.
You may need to make longer-term plans if, for example, you have been diagnosed with dementia and you may lose the mental capacity to make your own decisions in the future.
A Professional Court of Protection deputy is a solicitor who has been instructed to manage the affairs of someone who lacks the mental capacity to make some or all decisions themselves. This can be concerning their property and affairs or even health and welfare.
This Deputy can be chosen by either the Court of Protection or by a family of the persons who require a deputy.
A Grant of Probate will confirm the authority of the executor to administer the estate of someone who has died, this will include tidying up the affairs and distributing the assets to their heirs.
